Title:  Non Hockey Canada Program Participation Sanctions (Volunteer)

Definitions:

Involved with: refers to volunteers, staff paid/unpaid, parents of players, and anyone else deemed (by the Board of Directors) to have vested interest in the success of a non Hockey Canada Program.

Players: refers to any youth participating on a team as a regular or call up player for any duration of a game or practice.

Parents of a player: refers to the custodial parent(s) or guardian(s) of a player.

Rational:   With the increase in Non Hockey Canada Programming and the proclivity, and opportunity for player and volunteer poaching/recruitment it is KMHA’s intention to create a safe environment free from harassment and pestering caused by poaching/recruitment for all of our players and families. It is also KMHA’s responsibility to protect private and confidential information such as player/parent contact information. Having volunteers actively involved with competitors creates an environment where we are not taking every opportunity to protect this confidential information.

KMHA identifies that different levels of involvement provide different levels of risk for information to be spread. As such KMHA will utilize a multi level system to define participation as a volunteer in this policy.

Policy Statement:

Volunteers will not be selected for any position in KMHA that has access to confidential information from anyone involved with, or with immediate family involved with/playing on a Non Hockey Canada Sanctioned league.  Volunteers found to be involved with a Non Hockey Canada Sanctioned Hockey League Program during a KMHA season will be immediately removed from their position. This action is taken to protect the information of our participants in line with current legislation. 

KMHA will utilise 2 tiers for returning to participate with KMHA as a volunteer.

Tier 1:  Potential Volunteer has (a) participant(s) involved with Non-Sanctioned Hockey. This is the case where a parent/guardian has as recently as last season participated in Non-Sanctioned Hockey. This potential volunteer for KMHA has not however been involved in any volunteer or paid role with a Non-Sanctioned league/program. This potential volunteer can apply and be selected to the KMHA once they no longer have a participant involved in non-sanctioned Hockey.

 

Tier 2: Potential Volunteer has participated or volunteered for Non-Sanctioned programming.

The potential volunteer will be ineligible to volunteer with KMHA will not be selected to any team or program until 5 years has past and a vote of the Executive committee of KMHA passes their return to volunteer. Any Tier 2 volunteer(s) that have ceased participation may make an appeal to return to KMHA, 1 year after their participation with a non-sanctioned program cease.

Any recruitment of KMHA participants to a non-sanctioned league by KMHA volunteers will automatically result in the KMHA volunteer being added to tier 2 (Volunteers currently serving will be removed immediately and replaced by KMHA).

Appeals: Any volunteer may make an appeal to the 5-year term by applying for re-instatement through the board of directors. The re-instatement process will consider a person’s length of involvement in a non-sanctioned program, their role, level of access to information, and any investment or stake they may have in a non-sanctioned program. Mitigating circumstances for a denial of reinstatement can include but are not limited to being found by KMHA to have misused any private or confidential information such as participant contacts, being found to be actively recruiting participants from KMHA to a non-sanctioned league and having a vested interest such as ownership in a non-sanctioned program.
